Morales & Besa’s Litigation and Arbitration practice is central to what we do. We advice on  all categories of disputes and conflicts. Our team works in an integrated manner with all the other practice areas of the firm.

We regularly represent our clients before ordinary and special courts. We also actively participate in arbitrations before the Arbitration and Mediation Center of the Santiago Chamber of Commerce (CAM), before the National Arbitration Center (CNA) and before special arbitrators, as well as before international arbitration centers, such as the International Chamber of Commerce (ICC) and the American Arbitration Association (AAA).

The disputes we engage in on behalf of our clients are typically complex and significant for our clients. Our group of experienced lawyers are able to handle the sensitivities that this kind of dispute often throws up.

A number of our partners serve as arbitrators for the Arbitration and Mediation Center of the Santiago Chamber of Commerce (CAM) and the National Arbitration Center (CNA).

Public University
We advised a major Chilean public university in a dispute with a recognized international construction company, regarding a contract for approximately USD 56 million for the construction of a university campus located in downtown Santiago.
Mining Company
We are representing one of the largest copper mining companies in the world in an arbitration suit related to the execution of an EPC contract for the expansion of our client's refining plant.
Concessionaire Company
We successfully represented a concessionaire company in an arbitration for an amount of USD 230 million, with a major international construction company, which incurred in serious breaches of the EPC contract that compelled it to build the concessioned works for the benefit of our client.
Concessionaire Company
We are representing a concessionaire company before the arbitration commission established in a concession contract, regarding a lawsuit aimed at adapting the contractual conditions, so as to distribute the decrease in revenues produced by COVID-19, which has been estimated at several hundred million dollars.
